Supreme Court uphelds 10% quota for Economically Weaker Sections
On 7th November 2022, the Supreme Court upheld the Constitutional validity of the 103rd Constitutional Amendment.
The 103rd Constitutional Amendment, amended Articles 15 and 16 of the Constitution of India .
The matter was heard for 7 days by CJ UU Lalit, Justices Dinesh Maheshwari,
S Ravindra Bhat, Bela M Trivedi and JB Pardiwala
It was observed that the amendment based on economic criteria does not violate the basic structure of the Constitution.
The Basic Structure cannot be said to be violated because of the 50% ceiling limit fixed by the Mandal Commission.
The Court further agreed to relook the reservation s and the caste system in India.
The majority upheld the constitutional validity of the amendment but it was dissented by CJ UU Lalit and J. S. Ravindra Bhat
