The term “Abhidhvaj” is a composite of two Sanskrit words, “Abhi” and “Dhvaj.” “Abhi” signifies “commencement,” and “Dhvaj” denotes “nation.” Consequently, “Abhidhvaj” encapsulates the concept of a nation’s inception, or Beginning or initiation. It’s noteworthy that the term “Abhidhvaj” draws inspiration from the revered scripture, the Shrimad Bhagwat Geeta. Theme

The introduction of the Bharatiya Nyaya Sanhita (BNS), Bharatiya Nagrik Suraksha Sanhita (BNSS), and Bharatiya Sakshya Adhiniyam (BSA) marks a significant overhaul of India’s criminal justice system. These new laws, which came into effect on July 1, 2024, replace the colonial-era Indian Penal Code (IPC), Criminal Procedure Code (CrPC), and Indian Evidence Act, respectively.

Key Features

Bharatiya Nyaya Sanhita (BNS): This law introduces new crimes, including those related to deceitful means in sexual intercourse, which can attract penalties of up to ten years. It also recognizes murder based on caste, community, or race as a distinct offense. Additionally, it encompasses organized crime and terrorism under its provisions.

Bharatiya Nagrik Suraksha Sanhita (BNSS): This law enhances the procedural framework for criminal investigations. It emphasizes the use of technology, allowing for online FIR registrations and mandating forensic investigations for certain offenses.

Bharatiya Sakshya Adhiniyam (BSA): This act modernizes the handling of evidence, accommodating electronic and digital records, thereby improving transparency and efficiency in legal proceedings.

Implications

The new laws aim to address contemporary issues within the Indian legal framework, promoting a citizen-centric approach to justice. However, they have also sparked debates regarding certain provisions, with critics expressing concerns about potential misuse, particularly concerning the criminalization of consensual relationships and vague definitions of crimes.
