Theme

Illegal and Unconstitutional (2013)

In 2013, the Supreme Court declared NEET as illegal and unconstitutional. The court ruled that NEET violated the rights of private medical colleges to admit students as per their own selection procedures.

Restored and Allowed (2016)

However, in 2016, a five-judge Constitution bench of the Supreme Court recalled the earlier verdict and allowed the Central Government and the Medical Council of India (MCI) to implement the common entrance test (NEET) until the court decides afresh on its validity.

Controversy and Allegations (2024)

In 2024, the NEET-UG exam faced several controversies, including allegations of paper leaks and irregularities in the conduct of the exam by the National Testing Agency (NTA).

Multiple petitions were filed in the Supreme Court challenging the conduct of the NEET-UG 2024 exam, including issues like paper leaks, grace marks, and other irregularities.

The Supreme Court expressed concern over the alleged discrepancies and ordered a re-test for 1,563 candidates who were given grace marks.

Government’s Stand (2024)

The Central government opposed the scrapping of the NEET exam, stating that it would jeopardize the interests of the large number of honest candidates who took the exam.

The government said the CBI was conducting a thorough investigation into the alleged irregularities and that the new Public Examination (Prevention of Unfair Means) Act, 2024 provided for stringent punishment for offenses related to unfair means in exams.

In summary, while NEET was initially declared illegal and unconstitutional in 2013, it was later restored and allowed by the Supreme Court in 2016. However, the 2024 NEET-UG exam faced significant controversies and allegations, leading to judicial intervention and a re-test order, even as the government defended the exam’s continuation.
