Eligibility Criteria for Aspiring Law Clerks in AP High Court

  • Professional Status: Candidates should not be pursuing any other regular course of study or profession that would necessitate their absence from work during their engagement as a Law Clerk. If a candidate is enrolled as an Advocate, they are required to suspend their practice before joining the Law Clerk position and maintain this suspension throughout their clerkship. It is important to note that a Law Clerk is not treated as an employee of the High Court Service or the Judicial/Judicial Ministerial Service.

Law Clerks play a vital supporting role for the Hon’ble Judges.

  • Honorarium Details: The appointed Law Clerks will receive a fixed consolidated honorarium of Rs.35,000/- (Rupees Thirty Five thousand only) per month. It is specified that Law Clerks are not entitled to any other allowances or perks.
  • Core Duties and Responsibilities: The primary duties involve assisting the Hon’ble Judges in both their judicial and academic capacities. This includes:
    • Reading case files, preparing case summaries, detailed notes, and chronologies of dates/events.
    • Identifying key facts, legal issues, and questions that may arise during proceedings.
    • Conducting comprehensive research work, which encompasses case laws, articles, judicial orders, and preparing study material for conferences, seminars, and meetings.
  • Access Privileges: Law Clerks are granted access to the Court Halls and Judges’ Library. They can also access Computers and the Internet within the Chambers of the Hon’ble Judges, under their direction and with prior permission.

Terms of Engagement & Conduct for High Court Law Clerks

The assignment of a Law Clerk comes with specific terms and a strict code of conduct:

  • Period of Assignment: The engagement is typically for a period of one year starting from the date of assignment. This period can be extended for a further period not exceeding four years, contingent on the approval of the Hon’ble Chief Justice. However, assignments may be discontinued without notice if the services are deemed unsatisfactory.
  • Leave Policy: Law Clerks are entitled to Casual Leave at the rate of one day per completed month of assignment. They can proceed on casual leave with prior intimation to the Hon’ble Judge they are attached to. The maximum Casual Leave permissible in a Calendar Year is 12 days, and any excess leave will result in pro-rata deductions from the monthly honorarium.
  • Professional Conduct: Every Law Clerk is expected to maintain a high standard of dignity, reputation, and integrity commensurate with their responsibilities. They must maintain complete and utmost confidentiality regarding all assigned work, information, or documents. Any breach of this essential condition will lead to appropriate action.
  • Employment Restrictions: During the assignment, Law Clerks are not entitled to take up any full-time or part-time employment or engagement whatsoever. However, with the consent of the Hon’ble Chief Justice/the Committee, they may be permitted to appear for examinations conducted for selection of Junior Civil Judges. Similarly, with permission, they may suspend practice to appear for the All India Bar Examination (AIBE).
  • Dress Code: A specific dress code is prescribed for Law Clerks:
    • Male Law Clerks: Black Trousers, White Shirt (Full Sleeves), Black Coat with Black Tie, and Black Shoes.
    • Female Law Clerks: White Blouse with Light Colour Saree OR White Salwar Kameez with Black Dupatta OR Black Trousers with White Shirt, and Black Coat.
