Advocate Empanelment: Criteria for Legal Practice Across Courts
The New India Assurance is seeking Advocates for various courts and commissions, each with specific eligibility and experience requirements. To be eligible, an advocate must hold a Bachelor’s Degree in Law from a recognized university, be licensed to practice by the Bar Council, and have registration with the State Bar Council.
Here’s a breakdown of the experience required for different judicial forums:
- Delhi High Court: Applicants must have a minimum of 7 years of practice from their date of enrollment. Crucially, out of these 7 years, at least 4 years should include experience in Motor Accident Claim Tribunal (MACT)/District Consumer Commission/EC Commission/State Consumer Commission cases, with one year specifically at the High Court/NCDRC (National Consumer Disputes Redressal Commission).
- Delhi State Consumer Disputes Redressal Commission: Candidates need at least 5 years of practice from their enrollment date. Within this period, a minimum of 3 years must involve experience in MACT/any Consumer Forum/EC Commission cases.
- MACTs/District Consumer Forums of Delhi and Haryana State (specifically Gurugram, Nuh, Faridabad, and Palwal): A minimum of 3 years of practice from enrollment in Civil/Criminal Courts is required. From this, at least 1 year of experience must be in dealing with Motor Accident Claim cases, EC Commission cases, or District Consumer Forum cases.
- Employee Compensation Commissions of Delhi and Haryana State (specifically Delhi, Gurugram, Nuh, Faridabad, and Palwal): This category is open to Retired Employees of the Public Sector General Insurance Company (PSGIC) Industry. They must possess at least one year of past experience working in a Motor Third Party (TP) Department, TP Hub, or Legal Department. Such candidates will also be considered for MACT/EC/District level Consumer Forum work.
Retainer Positions
The company is also looking for Retainers for the Delhi State Consumer Disputes Redressal Commission and MACTs of Delhi. This includes specific court locations such as Tis Hazari, Karkardooma, Saket, Rohini, Dwarka, and Patiala House.
- Eligibility: This opportunity is primarily for advocates already on the panel for the mentioned commissions and MACTs. Existing retainers who wish to continue their association are also required to apply.
- Experience: Applicants must demonstrate at least 3 years of practice in the specific court where they intend to apply for retainership.
Law-Related Investigator Roles
While not strictly an advocate role, the empanelment also extends to Investigators for Motor Accident Claim Tribunal cases, Third Party matters, and EC Commission cases in Delhi and Haryana State (Gurugram, Nuh, Faridabad, and Palwal).
- Eligibility: Candidates must be Graduates in any discipline. However, a law graduate and/or individuals with related experience of working within an insurance company will be preferred. This indicates a strong preference for candidates with a legal understanding or background relevant to insurance claims.
