Gujarat High Court allows 11-year old, raped by her father to abort pregnancy by invoking Durga Saptashati

Justice Samir Dave, invokes Durga Saptashati, a Hindu religious text while hearing the plea of a rape survivor for abortion.

Durga Saptashati is believed to be both a culmination of centuries of Indian ideas about the divine feminine as well as a foundation for the literature and spirituality focused on the feminine transcendence in centuries that followed

The Court observed:

The Court further observes that there is no higher insult to a woman than trying to touch her dignity.

In the present case, the 11 years and 9 months old girl child was subjected to the heinous crime by none other than her own father.

The Single Judge Bench ordered the State to pay a compensation of ₹2.5 lakh within a period of two months

The Bench allowed the plea for abortion because the risks for the development of complications were higher due to the tender age of the survivor.
